March 27, 2006

Perhaps the biggest revelation of the recent '60 Minutes' airing of its investigation into the Duke Hoax was presentation of the video tape showing the accuser enthusiastically dancing on stage at a local strip club, reportedly two weeks after that alleged assault that supposedly left her too traumatized to speak a month later, according to DA Nifong. Her eager public dance also appears to belie the description of being so shaken by the non-event that she screamed at the site of white men.
“In the days and weeks after the attack the accuser went back to the hospital complaining of neck, back and knee pain she claimed was caused by the rape. 60 Minutes obtained a video of her dancing at a strip club two weeks after the alleged attack. The club manager told 60 Minutes that she had consistently performed her routine normally.” '60 Minutes' Transcript
It is fitting irony that two weeks after the non-event, the reported time of the taping of the video shown by CBS, coincides with DA Nifong’s March 27 proclamation of guilt. Around the time, the accuser was performing her routine in a strip club, Mr. Nifong was telling the world of the “brutal” assault.
"The information that I have does lead me to conclude that a rape did occur," Nifong said. "I'm making a statement to the Durham community and, as a citizen of Durham, I am making a statement for the Durham community. This is not the kind of activity we condone, and it must be dealt with quickly and harshly." NBC 17 March 27, 2006
On March 27, around the time the accuser was performing on a stage, DNA samples were sent from the Durham Police Department to the State Bureau of Investigation.
“Local authorities have asked state forensic technicians to place top priority on analyzing DNA from members of the Duke University men’s lacrosse team in connection with a rape investigation.” NBC 17 March 27, 2006
On March 27, Ruth Sheehan called for the lacrosse team to be “shut down,” while the “traumatized” dancer “consistently performed her routine normally.”
“They shouldn't have to wait for 46 DNA samples to be returned. Every member of the men's lacrosse team knows who was involved, whether it was gang rape or not. Until the team members come forward with that information, forfeiting games isn't enough. Shut down the team.”
On March 27, a search warrant was issued for Ryan McFadyen’s dorm room. The warrant described the “crimes” as first degree forcible rape, First Degree Kidnapping, First Degree Forcible Sexual Offense, Felonious Strangulation and Conspiracy to Commit Murder. While McFadyen’s room was searched, the stripper may have been performing on stage.

Two days prior to the date that marked two weeks from the non-event, the News and Observer told the world:
"This was the first time she had been hired to dance provocatively for a group.” N&O March 25, 2005
On March 27, this article was the N&O’s most viewed online item. While the world read of the beaten and assaulted student hired to dance for the first time, the industrious accuser performed her routine on stage.

Soon after March 27, we would read:
“The stripper who charges she was raped by Duke University lacrosse players is so traumatized she sometimes screams at the sight of white men in the street” NY Daily News
While we were led to believe that she screamed at white men in the street, she continued dancing for dollars.

We see video of her dancing around a pole in a club two weeks after the non-event, yet Mike Nifong tells the court on September 22 that as of April 11 she was too traumatized to relate any details about the case in his meeting with her.
“The D.A.’s justification for this peculiar silence by the accuser, which Nifong said he provided on p. 2030 of the discovery? The accuser, reasoned he, was still very traumatized by the March 14 (or March 13-14, as things now stand) event.”
“So, according to Nifong, the accuser was too traumatized to speak of the incident on April 11, yet not so traumatized as to conduct an eyewitness ID session on April 4 upon which the police relied to make identifications; and give a statement on April 6 upon which the police relied to establish that a crime occurred?” KC Johnson
Knowledge of the fact that while the dancer danced, Nifong and his media helpers, presented a false impression of a woman so traumatized that she screamed at white men on the street, and was too traumatized to speak to the District Attorney, only serves to further reveal the level of deception presented by Mr. Nifong and the media in the promotion of this terrible Hoax.

This is my view of the accuser. She is corrupt. She has no respect for herself, her children, or her family and friends. This woman is being used by the most villainous people in society, especially her
employer and Nifong. She is so depraved, she can't even recognize
her rotten condition. She has lost
her dignity and no one has the integrity to tell her. There are so many more honorable options for her, but she is satisfied with making a fast buck. It doesn't bother her to lie because she has no conscience.

Yes, she carries a large part of the blame for this hoax, but there are many others that are party to it as well. Nifong, the Durham PD, N&O, Herald Sun, NY Times, Duke U.; to name a few. None of these participants are willing to stop and look at the evidence and declare this to be what it is. Instead they either ignore the case or continue the hoax. Hopefully when the case reaches its fair conclusion (the complete exoneration of the accused) they can find some way to make all of these that are party to continuing the hoax pay dearly for their participation. Maybe they can start their own chain of newspapers and own a private university. Firing 88 professors would be fun for them in my opinion.

The accuser is just being used one more time by Nifong. My theory is that he will leave her holding the bag when he can no longer delay admitting he has no case. He'll say it's all her fault. She started it. She had every opportunity to back out. I can hear it now.

Why doesn't she reach out to Cash Michaels, sharpton, jackson??

I think that this information about the accuser takes her to the next level in terms of her own guilt. Clearly some of the statements about her being traumatized and injured, and the fact that she returned to the hospital to try to have documentation of such, shows her active participation to perpetuate the HOAX which she started. This clearly is not a person that deserves ANY sympathy whatsoever. What she deserves is time in jail, which she somehow escaped in her last brush with the law.

I agree that the accuser is culpable, and more so now that I have seen her activities while the Hoax was in its infancy. I think she really went back to the hospital to score some more Flexeril or oxycodone or something and the attempt at additional documentation of injuries was secondary. Nifong, the N&O, etc. have exploited her for their own gain. Sending her from Durham Access to a psych ward for rehab would have been a kinder gesture.

Her dancing on or around March 27 belies the claim by Nifong that he did not talk about the facts of the case with the accuser at the key April 11 meeting between Nifong, the accuser, Sgt Gottlieb etc. because she was too "traumatized." Nifong lied to the court about this matter.

My husband keeps getting REALLY frustrated with my talking about things like perjury and injustice. He keeps explaining to me that NOWADAYS, people lie under oath in state and federal court ALL THE TIME. That's why I wouldn't take anything for granted in the exposure of the Hoax. Nifong, Gottlieb, et. al. will lie till the cows come home.

I'm just curious to know how long it will take the City of Durham to pay restitution for this lynching, and how long Nifong will fight to have his future disbarment overturned. I can understand and, to an extent, forgive prosecutorial error. No one is perfect, and as long as said error is harmless and unintentional, while I'm not happy, I can see where it could occur. However, Nifong has engaged in willful, grossly harmful misconduct, and it is this which I find utterly contemptible and unforgivable from a man to whom the public faith has been entrusted. By his actions and words, he has jeopardized and given cause for review of every case he has handled in the last 25 years. How many legitimate rapists and other violent criminals will have their cases overturned as a result?

Anonymous said...

Hopefully not that many, cause, as I understand it, Nifong spend a lot of his time in traffic court.

I agree with you that this was a significant part of the broadcast. While I have written much about this case, I was not aware of the video's existence, and it was a bombshell. Thank you, Liestoppers, for putting it into perspective.

My fervent hope is that this case NOT go to trial, as anything can happen. Mangum and Nifong and Brodhead are a triumverate of evil.

Could some of the above posters please send their thoughts to the HeraldSun as a letter to the editor?

1.there was no time stamp on that video. you only have the word of 60 minutes when it was taped. you only have their word the owner of the club said it was her. the owner was not on camera. the woman did not look like the woman in the photos. the woman on the tape was taller and thinner and had a lighter complexion. That could have been a video of any black dancer in a club

2.this was just another attempt of the defense to smear the dancer. note that cheshire was quoted about the video in the paper the next day. face it, the defense gave the so called video tape to 60 minutes.

3.bradley also said that 60 minutes had seen "almost the entire case file". like dan abrahms and others, he did not see the whole case file.

4.ed bradley's boss is a duke alumnus and he is trying to protect duke like susannah meadows of newsweek did and like dan abrahms did.

5.did you all check the local nielsens? not a lot of people watched it around here and even though you yankees think you can tell us what to do, the people down here are the only ones that really count come election day.

To 3:14 AM. You are sooooo wrong!!
Please think before you write. The
Yankees won because they were fighting for the truth.
Also, although we won't try to tell you want to do, we do insist on proper punctuation in the construction of sentences.

3:14:
1. You mean time stamps like the ones that help to show definitively that Seligman's alibi is airtight? Don't forget the word of Cousin Jack who admits the false accuser continued to dance. 2. Face it, the woman's dancing immediately after pretending to have been assaulted smears herself. The woman's employment as a paid escort and her activities prior to the party smear herself. Her inconsistent stories smear herself. Heck, Nifong doesn't even buy her crap and had to invent his own stories to try to fit the evidence. 3. So in what he didn't see, you are expecting what? Other's have seen the whole file. What 60 presented came from Nifong's own "evidence." Is there something hidden that will show the lineups did meet standards, the DNA did match, the accuser did not contradict herself, the witnesses, the evidence and even Nifong's version of events??? 4. It's all some great big Duke conspiracy, eh? Yep, Ed Bradley is protecting Duke, Cash Michaels has been bought off by Duke, Duke Hospital removed the DNA of the boys and replaced it with DNA from her boyfriend... 5. Over 17 Million homes tuned into 60 Minutes, better than 1 in 10 nationwide, the highest rated 60 show since January but "not a lot of people watched it around here" uh huh...that makes sense... Getting a little desperate aren't you?

To Anon at 6:07 and 6:53,

The Anon at 3:14 is the skatester. The skatester doesn’t have time to be bothered by the use of proper grammar and sentence structure. Unfortunately, s/he also generally shows no concern for mundane concepts like facts, the truth and evidence.

Hey skate, I see you’ve managed to slip your restraints again. You must be in a rush; you forgot to bash Cheek in your rant above.

What’s that you say? You hear a “Code Blue.” Well, OK then.

i am not a skater or whatever the hell you are saying. just a person who does not like yankees trying to tell us what to do.

Greetings from Dixie, anon 3:14 and 10:41. This son of the South would like to know what regional pride has to do with your flagrant disregard for truth and justice and for that matter, REALITY? Regional shame is appropriate here. You are a disgrace to your community and state; Durham is revealed to all, for all its shiny office buildings and medical complex and md's, phd's and mba's, as a backward, corrupt nest of filth-- apparently thanks to people like you. Help clean the place up: Buy yourself, and your fellow traveler in lying to maintain a facade of propriety, one Richard the Rat Broadhead, one-way tickets North or West and brang yoself a moonpie an' a cold drank for the long trip', y'all, because we don't need folks like you around here. Free the Duke Three; Disbar and Imprison Nifong.
