The Wrongful Prosecution of the Duke Lacrosse Team

The most notable criminal case our Firm has been involved in is, unquestionably, the investigation, prosecution, and exoneration of the Duke Lacrosse Team. In the days before the case became a national controversy, many members of the men’s lacrosse team came to our Firm with a problem of the most serious kind: they were accused of a horrific sexual assault that did not happen. The accusation, we knew, would threaten the reputations of all of them and their families, and that restoring their reputations meant proving their innocence. We accomplished this through the joint-representation of over thirty of the team members. Using metadata in the digital files of pictures taken during the night, cell phone records, dorm-access card reports, and the collective memory of all of the team members, we constructed an irrefutable digital timeline of events of the evening that ruled out the possibility that the accuser was sexually assaulted by anyone. Before any charging decisions were made in the case, all 47 members of the men’s lacrosse team had immutable digital alibis that were corroborated by the witness accounts of every individual present. On April 17, 2006, two boys were wrongfully indicted. Our Firm issued a press statement asserting their innocence:

"Today, two young men have been charged with crimes they did not commit. This is a tragedy. For the two young men, an ordeal lies ahead. …They are both innocent."

Almost a year later, on April 11, 2007, the North Carolina Attorney General announced that his Special Prosecutors, Jim Coman and Mary Winstead, and SBI Agents Greg Tart and DeSilva, drew the same conclusion; they declared the accused were innocent. Special Prosecutors Jim Coman and Mary Winstead, relied heavily on our timeline of digital evidence and our synthesis of corroborating witness accounts in their conclusion that the sexual assault Crystal Mangum claimed did not happen. Jim Coman described the timeline of digital evidence “irrefutable” and “unalterable.” Coman and Winstead used it extensively in their report on their investigation and conclusions, published in April of 2006, entitled Summary of Conclusions. We are enormously proud of the role we played in the case and working together with many fine defense attorneys, as well as with Jim Coman and Mary Winstead to establish the truth of this matter so clearly that they could do more than merely dismiss the cases, but also declare innocence. This complaint is an amazing document.

It calls itself a "reckoning". Considering the scope and detail of this 400 page complaint, that is what we are finally going to get.

Luckily, most of those who need to face the reckoning are still hanging around.

The complaint is clearly not written for a judge to read in the privace of his chambers. It is written as a history lesson, complete with citations to evidence and authority you do not normally see in the first pleading in a civil action.

This is going to be interesting.

For those concerend about the odds of successfully proving that this was a conspiracy, or not, the following struck me.

Conspiracy is only one of the thirty-five cause for action(s).

THIRTY-FIVE!

It doesn't matter if they can prove a conspiracy occured, what else happened was bad enough.

Also, the "clinically unreliable accusser" walks free to parent her children. Those that allow those children to be subjected to CGM must have a difficult time sleeping.

The allegations of the complaint become more disturbing upon re-reading. The allegations describe serious crimes committed against multiple Duke students with the active aid and acquiescence of the current Administration and Board.

Does anyone care enough about Duke to do something about the gestapo mentality of the current administration and Board?

Apparently the Department of Justice will not investigate Mr. Steel, a member of the Bush administration.

Just asking. I did not attend Duke. Thank goodness.

This Complaint is mindboggling. My mouth sounded as if it was on auto-pilot because it kept saying "My God, it's worse than I thought!" over and over again. And it is.

I tell you, if Duke thinks Brodhead can smirk his way past these 35 causes of action, then Duke justly deserves the writer's cramp it will get afterwards from scribbling in all those zeros on the checks made out to Ryan, Matthew and Breck.

If you think that they're going to take the word of Nurse Levity that she didn't do everything wrong over all the evidence that she misrepresented medical findings to a political purpose, you're just not in reality.

I know an allegation and wrong information when I read it. No one can prove she did anything wrong - she helped with the rape kit that exonerated the team. That trumps all. She never misrepresented medical finding - ain't so.

There is so much more to come out of Durham than the LAX case. The entire legal system is broken, the cops are thugs and worse than you can imagine. Countless elected officials from the Governor, down to the City Manager, to the County Clerk are involved. Many fingers have dipped into Durham's cookie jar, and the truth will be extremely explosive to many who have turned their backs on citizens, justice, and any code of ethics or valor. Embrace yourselves for an extreme shock. A tidal wave of truth will boggle your mind, the corruption SHALL be exposed!

She misrepresented the truth about the rape exam, which was a deliberate act of fraud. She belongs in jail.
