“Steel is going to f**k those lacrosse players.”

(Ekstrand & Ekstrand LLP has filed an amended complaint)

(Case 1:07-cv-00953-JAB-WWD Document 33-2 Filed 04/17/2008 Page 139 of 486)

XVII. THE CHAIRMAN’S DIRECTIVE

445. The Chairman was aware that Mangum was a deeply disturbed young woman who exhibited signs of psychosis, and that her accusations were false.

446. The Chairman was aware that Gottlieb was on a vendetta in response to the Gottlieb Dossier.

447. The Chairman was aware that Nifong was preparing to ride the case into office.

448. The Chairman knew that Addison was lying publicly about the evidence.

449. The Chairman was aware that the investigation belonged to the Duke Police Department.

450. The Chairman knew that, if the public perceived Duke abandoning the Plaintiffs, the public would conclude that Duke knew they were guilty.

451. The Chairman knew Plaintiffs were innocent, and, to the extent he was not certain, he ensured that neither he nor any senior University officials saw the evidence of innocence that he knew was offered.

452. To the Chairman, Plaintiffs’ innocence was irrelevant: what was “best for Duke” turned upon perception.

453. Aware of these things, the Chairman announced that it would be “best for Duke” if Plaintiffs were tried and convicted on Mangum’s false accusations.

454. In response to a plea for Duke to show some measure of support for the students who were being framed in plain view of the University’s leadership, the Chairman explained, “sometimes individuals have to be sacrificed for the good of the Organization.”

455. The Chairman’s Directive, as it was understood by one who received it, was straightforward: “Steel is going to f**k those lacrosse players.”

XVIII. THE CONSPIRACY TO CONCEAL THE DUKE POLICE DEPARTMENT’S STATUTORY AUTHORITY TO INTERVENE AND INVESTIGATE

456. To that end, the Chairman directed the Duke Police Department to act in furtherance of that objective. For example, the Chairman, through Brodhead, Trask, Burness, and Graves, directed the Duke Police Department:

A. To cease all efforts to find evidence of the truth, particularly evidence that
contradicted the accuser’s account;

B. To conceal evidence of Duke Police Officers’ prior investigative role in the
investigation;

C. To conceal all evidence of the Duke Police Department’s primary jurisdictional authority to control the investigation and its power to intervene to prevent the wrongs conspired to be done;

D. To fabricate false and misleading police reports, disguise them as bystander
“witness” statements, that covered-up the Duke Police witnesses’ personal knowledge of Mangum’s psychosis, her radically changing story, the overwhelming consensus among her doctors and nurses at DUMC that she was lying, and the inability of any doctor, nurse, or police officer to find even a spider-web of evidence that she was raped or sexually assaulted; and

E. To direct those who were at the hospital on March 14th to give “not-for attribution” false reports about Mangum’s appearance at DUMC in order to lend credibility to Mangum’s false claims in the eyes of the public.

457. At all times subsequent to the Chairman’s Directive to force a trial and convictions, the Duke Police Department had the power to revoke its delegated authority and/or to intervene to prevent or aid in preventing the unlawful conspiracies and violations of Plaintiffs’ constitutional rights as alleged herein, and, yet, refused to do so.

458. At all times relevant to this action after March 25, 2006, the Chairman and the members of the CMT directed the Duke Police Department not to intervene to prevent or aid in preventing the wrongs that they knew were conspired to be done to Plaintiffs and their teammates by their co-defendants in this action. In compliance with the Chairman’s Directive, the Durham Police ‘turned a blind eye,’ and did nothing.

"F" the lacrosse players? Mr. Steele has audaciously moved on to bigger things. His legacy, believe it or not, will be his authorship in the long term damage to our economy and capitalism.

Consider the “Moral Hazard” damage due to Chairman Bob Steele's involvement in opening the discount window of the Fed for non-bank institutions? Consider how this action was undertaken.

Would Goldman Sachs and Merrill Lynch have joined Bear Stearns and filed bankruptcy the next Monday had Mr. Steele and the Fed not acted? One may speculate. Should you and I be bailing out speculators and what damage has been done in creating a safety net for stupid actions?

Regardless, Mr. Steele should not have any authorship in our economic future given his history of moral bankruptcy demonstrated at Duke.

We are in dire straits if this is the best we can produce. God help us.

By the way, how many of you are aware that the Sunday vote to open the discount window only included four Federal Reserve Governors? It takes five. Two seats are vacant and one voting member was in Europe. They had to utilize a depression era legal mechanism to enable a four person vote.

Who elected Bob Steele?

Given Bob Steele's history, I am very uncomfortable that he has any authorship in our economic future.

When will the Duke Board of Trustees act? Or are they a part of it also? Duke is run by criminals. The damages should be in the hundreds of millions.

One of the major puzzles of the Hoax has been how so many Duke faculty and employees could do so many things morally and even criminally wrong against Duke students and not be punished.

A very scary answer may now be emerging, if these new complaint allegations can be proven. A possible explanation of the puzzle is that Duke's participation in the frame was coordinated at the highest levels. The BOT itself was in it up to their eyeballs.

So, they could not later punish anyone else. Everyone knew too much. This is the essence of a criminal conspiracy.

What could possibly be Mr. Steel's motivation? One suggestion I have seen is to look at the timing of Mr. Steel's candidacy and eventual selection to be Under Secretary in the Bush administration. His nomination within the administration was likely being vetted as early as March/April of 2006.

Does this possible motivation to sacrifice innocent students to criminal prosecution for political gain ring a bell? It is deja vu all over again.

If Mr Steel viewed the Duke Lacrosse team's supposed gang rape as a threat to his career progression, that could offer enough motivation for an ambitious man to do awful things.

Let us hope the civil suits get to the bottom of the facts, one way or another.

I agree with 8:39 AM, it does appear that someone must have spilled previously unspilled beans to get some of the details we're seeing here.

One thing that does worry me, though, since it's going to make the case a lot harder to prove, is item 453:

453. Aware of these things, the Chairman announced that it would be “best for Duke” if Plaintiffs were tried and convicted on Mangum’s false accusations. (emphasis added)

Now I think it's pretty much a slam-dunk to prove that Steel viewed it as best for Duke if the accused players were put on trial despite the flimsiness of the charges. But proving that Steel actually wanted their conviction for the benefit of Duke, rather than wanted them to be tried by the court and viewed conviction as the most likely result of that trial.

My very thought, I sure hope they have something in writing.

What I cannot fathom is Steele's callous attitude that the reputation of Duke would take precedence over the civil rights of any Duke student, let alone three. How could he not see, for someone so concerned about an institution's reputation, that by not protecting the most important people within said institution, the students, that in the end there would be no institution to protect?
When is the rest of the BOT going to realize that great harm has been done to the reputation of Duke by Steele, Brodhead, Moneta, Wausiolek, and the leftist-PC crowd that purports to teach critical inquiry?

With more and better students applying to Duke and the endowment rising, can't see that this event has caused them great harm.

Note the drafting - the perception of someone was, "Steele is going to F them". Steele isn't quoted. Someone is talking, and telling the attorneys his/her perception was that Steele was sacrificing the players.

I'm not sure I like this strategy. The Complaint is already filled with hyperbole - this isn't necessary.

whoa, this is HUGE. Someone is talking now, and I doubt good attorney's like Ekstrand would be making this stuff up. I would not be surprised to see some resignations soon.

Discovery on this allegation will be interesting.

Does the public have the right to see responses to discovery requests?

I don't understand why Steele's involvement in the Duke coverup has not hit the press. There was a headline in the business section of the Washington Post calling him "a problem solver". A "problem fixer" is more like it. There is no doubt that Steele was pulling the strings. I think he honestly believed that the boys did it and when the truth started appearing, he was too far gone in the wrong direction. He;s from Durham and is the same age as Nyfong-he must know him personally.I think he was thinking, "I'm not going to let these GD lacrosse players ruin my school and my town." Steele personally gave a big donation to the Durham initiative after the onset of the lacrosse case. What was that about? I know that the majority of the BOT was being fed information by Steele-they were getting the 'cover up lines' also. Shame on them for not studying the situation and demanding the truth. B-head was Steele's puppet. With all the various investigation of Bush's administration-how is Steele getting a free pass?

If someone told me 10 years ago that the two massive skyscrapers known as the World Trade Center would essentially be taken down because of 2 razor sharp box cutters, I would not have believed it. So now I am not shocked that the reputation of a once fine university, and the American Justice system, has been turned on it's ear by a Nubian Princess with an unclean vagina

If Ekstand is such a good lawyer, how come it took, not only 600 pages of a filing filled with typos and misspelling, but another 450 pages in an amended filing to get the allegations out there?

I have been convinced for a long time that Durham native Chairman Stalin had Durham's best interests at heart and not necessarily Duke's or Duke students.

You have Duke's word that it has more and brighter applicants. Given its recent history, I would not be so certain that what you have either heard or read is the actual truth. There seems to be a shortage of that commodity in the Durham community.

I doubt that Crystal Mangun is a "Nubian princess," and for all I know her vagina could be clean.

But her conscience would not be, if she had one. Lock her up and then throw out the key!

To anonymous 12:41 pm. Hospital records showed that "Princess Mangum" had the DNA of at least 5 other males inside of her,for at least 3 days. I'm glad I don't subscribe to your standard of cleanliness.
